ECBAWM Files Federal Civil Rights Suit Challenging Dangerous NYPD Vehicle Pursuits

On October 15, 2025, ECBAWM filed a civil rights lawsuit on behalf of Delonny Davis, who was intentionally struck by an unmarked NYPD vehicle. The suit was filed in the United States District Court for the Southern District of New York, Case No. 25-cv-08501.
As surveillance video shows, in August 2023, in lower Manhattan, an unmarked police car swerved out of the middle lane of traffic and into the bike lane, striking Mr. Davis head-on and sending him flying off his motor scooter. Mr. Davis landed on the police car’s windshield and then fell onto the street and lost consciousness. The Defendant NYPD officers immediately arrested Mr. Davis and later made false statements to the Manhattan District Attorney’s Office, blaming Mr. Davis for the collision and falsely claiming that the “police vehicle . . .was attempting to avoid the collision.”
The suit alleges that the collision was a direct consequence of the NYPD’s 2022-2025 policy, articulated publicly by police brass, to encourage NYPD officers to use their vehicles as instrumentalities of force – to pursue, cut off, collide into, and otherwise seek to interdict and restrain motorists alleged to have violated the traffic laws. This policy was implemented and lauded by then-Chief of Patrol and former Chief of Department, Defendant John Chell as well as then-Deputy Police Commissioner, Defendant Kaz Daughtry.
