The Firm represents both employees and employers in contract disputes, pre-litigation negotiations, and employment termination and severance agreements. The Firm represented MortgageIT, a publicly traded mortgage bank, and Martha Stewart Living Omnimedia in their employment related disputes. We also represent both plaintiffs and defendants involved in common law claims such as breach of contract, tortious interference, defamation, unfair competition, and claims arising under restrictive covenants. The Firm is also experienced in mediation and arbitration.
Representative Cases:
- Wu v. Maroley Communications – Successfully represented the defendants in a $30 million breach of contract and breach of fiduciary duty action.
- Trump Marks v. Crescent Heights – Obtained a complete dismissal of a lawsuit brought by Donald Trump’s company seeking $45 million in connection with a real estate development in Tel Aviv.
- EchoStar Corporation LLC – Represented EchoStar in a number of appeals. In April 2010, the Firm represented EchoStar in the Sixth Circuit Court of Appeals in an indemnification dispute with Bank One over a co-financing arrangement for consumer purchases of satellite disks. In October 2010, the Firm represented EchoStar in two appeals in the First Department, Appellate Division arising out of a contractual dispute over EchoStar’s access to high definition television programming on the ESPN, ABC Family, and Toon Disney cable television networks.
- Pearce v. Manhattan Ensemble Theater – Successfully settled breach of contract action on behalf of Patty Duke after prevailing on theater producer’s motion for summary judgment.
