ECBAWM Files Amicus Curiae Brief in US Supreme Court Fair Housing Case

On August 9, 2023, ECBAWM, alongside Relman Colfax, PLLC, and Goldstein Russell & Woofer, filed an amicus curiae brief on behalf of three individual fair housing testers and the National Fair Housing Alliance in a case pending before the Supreme Court that implicates civil rights plaintiffs’ standing to sue in discrimination cases.

The Supreme Court will be deciding this term whether a tester with disabilities, who brought suit against Acheson Hotels, LLC under the Americans with Disabilities Act, may proceed with her lawsuit challenging the hotel’s failure to provide accessibility information on its website even if she did not intend to visit the hotel.

The brief sheds light on the harm caused by discrimination, regardless of whether the person discriminated against is a tester—harm which the individual testers and organizational amici alike are particularly aware of, given their decades of experience conducting fair housing tests.
