Temporary Restraining Order Granted in ECBAWM Lawsuit Challenging Mayor Adams’ ICE at Rikers Plan

In a case in which ECBAWM represents the New York City Council, New York State Supreme Court Justice Mary V. Rosado granted a Temporary Restraining Order prohibiting NYC government officials from taking steps toward allowing ICE to establish an office at Rikers Island. The Order comes in response to an Article 78 Petition filed by ECBAWM on behalf of City Council seeking to stop an Executive Order issued by the Adams Administration to allow federal immigration authorities into Rikers.
ICE has been banned from city jails since 2014 after sanctuary laws were enacted that sought to stop the use of New York City resources for federal civil immigration efforts. The lawsuit argues that the recent executive order was part of “corrupt quid pro quo bargain” between Mayor Adams and the Trump Administration after the Justice Department dropped its corruption charges against the Mayor.
A spokesperson for City Council Speaker Adrienne Adams said of the lawsuit, “the Council stands firm in our efforts to protect the rights and safety of all New Yorkers against attacks by the Trump administration and its agents.”
