Federal Court of Appeals Reinstates Emoluments Clause Lawsuit Against Trump

On September 13, 2019, the United States Court of Appeals for the Second Circuit reinstated a landmark federal lawsuit in New York against Donald Trump, prompted by his violations of the Domestic and Foreign Emoluments Clauses of the United States Constitution. The Second Circuit’s decision means that Trump may be ordered to provide extensive discovery into his business dealings with foreign and state governments.
