Daniel Peña

Daniel Peña joined the firm in 2025. Prior to joining the firm, Daniel clerked for Chief Magistrate Judge Sarah Netburn on the U.S. District Court for the Southern District of New York. Before his clerkship, Daniel was a Staff Attorney with the Bronx Defenders’ Immigration Practice where he represented non-citizen clients with complex criminal histories before the Executive Office for Immigration Review (EOIR), U.S. Citizenship and Immigration Services (USCIS), and various federal district and appellate courts across the country. Daniel also served as a Padilla attorney, advising clients and practitioners across the Bronx Defenders’ practice groups on collateral consequences for non-citizens navigating family court and criminal court proceedings.

Daniel graduated from the City University of New York (CUNY) School of Law in 2021 and served as Senior Staff Editor for the CUNY Law Review. Daniel was a member of the CUNY Immigrant & Non-Citizen Rights Clinic and CLEAR (Creating Law Enforcement Accountability & Responsibility) Project, representing clients in immigration proceedings and those who faced discriminatory treatment post-9/11. During law school Daniel interned at the Legal Aid Society, LatinoJustice PRLDEF, and the Immigrant Defense Project. Prior to law school, Daniel was a paralegal at a large international law firm in New York City. Daniel received a B.A. in International and Global Studies from Middlebury College.
