Dan Eisenberg is an experienced trial lawyer and investigator. He joined the firm in January 2023 following service as Deputy Staff Director & Senior Counsel to the U.S. Senate Permanent Subcommittee on Investigations, where he led bipartisan investigations into corruption and civil rights abuses. Previously, Dan litigated complex commercial and civil rights cases at Patterson Belknap Webb & Tyler LLP and clerked for the Honorable Robert P. Patterson, Jr., U.S. District Judge for the Southern District of New York.
Some of Dan’s recent highlights include:
- Securing the largest settlement in New York history for the death of an incarcerated person in a state prison. Settlement came on the morning of closing arguments following a two-week jury trial in the Southern District of New York.
- Securing judgment in a bench trial against U.S. Customs and Border Protection concerning tariffs on a breakthrough HIV medication.
- Successful defense of prominent New York cultural institutions, a university, and individuals in investigations by federal, state, and local law enforcement agencies concerning allegedly stolen artwork, alleged violations of U.S. sanctions law, and alleged misappropriation of grant funding.
- Successful defense of companies and executives in complex commercial disputes involving antitrust, false advertising, and breach of contract.
- Uncovering corruption and civil rights abuses of pretrial detainees at a prominent federal prison, and the sexual abuse of prisoners by Federal Bureau of Prisons employees at multiple facilities. These investigations precipitated reforms within the Federal Bureau of Prisons and by Congress, including passage of the Prison Camera Reform Act.
- Monitoring a large municipal police force’s compliance with constitutional policing practices pursuant to a Department of Justice Consent Decree.
