ECBAWM Recovers Nearly $3.6 Million for the Family of Heather Roselli Related to Her Tragic Death

ECBAWM attorneys recovered nearly $3.6 million for the family of Heather Roselli related to her tragic death, having been fatally suffocated by state aides while under the care of a New York state facility for people with disabilities. Holly Parks, Ms. Roselli’s mother and the administrator of her estate, brought cases against individuals who worked at the facility in the Western District of New York and against the State of New York in the Court of Claims.
In the federal case, ECBAWM won a Second Circuit Appeal regarding a $2.25 million judgment, stemming from a Rule 68 offer of settlement. In 2023, the Second Circuit agreed that, in addition the $2.25 million judgment, Ms. Parks was allowed to seek attorneys’ fees, as well as continue pursuing her Court of Claims case. In October 2024, ECBAWM won an additional $530,000 in attorneys’ fees and costs, and last week, the Surrogate’s Court of Monroe County approved disbursement of the final $800,000 ECBAWM obtained from the State in connection with the Court of Claims case, drawing to a close a long-fought battle for justice for Ms. Roselli’s family.
